DonationMatch, Inc. Privacy Policy

DonationMatch, Inc. (“DonationMatch”) respects privacy, and we know that many care about how information is used and shared. This Privacy Policy applies to the DonationMatch website www.DonationMatch.com, to all associated subdomains, online services, mobile and software applications, and those sites listed in the paragraph below labeled “Additional Websites Subject to the Privacy Policy” (collectively, the “Sites”). By visiting any of the Sites, you are accepting the practices described in this Privacy Policy. We encourage you to read this Privacy Policy and our Terms and Conditions of Use. If you disagree with any of the terms herein, please immediately discontinue use of the Sites.

DonationMatch provides this Information and Privacy Policy to inform you (the "User") of policies and procedures regarding the collection, use, and disclosure of information that DonationMatch receives from the following:

• Users in the general public ("Website Users") who visit and use the Sites. Website Users include, by way of example, but are not limited to, users who: submit feedback, questions, comments, or other user-generated content on the publicly-accessible DonationMatch support portal at http://donationmatch.zendesk.com; sign up to receive marketing and other communications regarding DonationMatch and its partners through the "Contact Us" or "Join our email list" or similar features available on the Sites; publicly state their preferences, experiences or interests regarding DonationMatch or DonationMatch's product or service offerings, in each case as expressed in the course of such user's use of the Sites by selecting a "Like," "Follow," "+1," or similar public designation of interest.

• Users who are customers or prospective customers of DonationMatch ("Services Users") who access and use DonationMatch-branded or DonationMatch-owned software-as-a-service (the "DonationMatch Applications"), whether on a trial, free, or paid subscription basis.

• Users in the general public who temporarily interact with the DonationMatch Applications in the course of participating in one or more online promotions, surveys, or other marketing campaigns or activities operated by DonationMatch or a Services User (“Social User”). The use of information collected through our DonationMatch Applications shall be limited to the purpose of providing the service for which the Client has engaged DonationMatch.

This Privacy Policy describes our policies and procedures on the collection, use, and disclosure of your information when you use DonationMatch Sites and DonationMatch Applications and tells you about your privacy rights and how the law protects you. 

If you reside in the European Economic Area (EEA) and are subject to the General Data Protection Regulation (“GDPR”), you may have us remove your information from our servers by emailing support@DonationMatch.com

Except as described in this Privacy Policy, we will not, without your consent, disclose, sell, rent, lease, or otherwise provide to any third party any personally identifiable information collected through the Sites or DonationMatch Applications.

INFORMATION DONATIONMATCH MAY RECEIVE FROM USERS

Website Users. If you are a Website User, in the course of using the Sites, you may provide DonationMatch with (i) personally identifiable information ("Personal Information") such as your name, phone number, and email address; (ii) information on behalf of an Organization (nonprofit, school, exempt organization, company, business, and/or brand) you represent (“Organization Information”); and (iii) feedback, ratings, suggestions, complaints, or other descriptions of your experiences (with DonationMatch, DonationMatch service users, or its partners), preferences, or interests in DonationMatch or the DonationMatch Applications ("Feedback").

Services Users. If you are a Services User, in the course of using the Sites or the DonationMatch Applications, you may provide DonationMatch with (i) Personal Information in your user or account profile with DonationMatch, such as your name, phone number, credit card or other billing information, email address, and home and/or business postal addresses; and (ii) Personal Information in your user or account profile with the third party social media platform providers that interact with the DonationMatch Applications (such as Facebook, Instagram, Pinterest, and/or Twitter), that may include, but are not limited to, your credentials and profile information you have elected to make public; (iii) information on behalf of an organization (nonprofit, school, exempt organization, company, business, and/or brand) you represent (“Organization Information”), such as EIN, name, contact information (yours and others'), event information and attendee demographics, program information; (iv) Personal Information of your Organization’s Partners that you elect to collect, process, and/or store in connection with Partners' participation in an event or promotion using the DonationMatch Applications; (v) Promotional discount codes (“promo codes”) and referral codes applied to your account for special benefits as a result of manual entry and/or clicking through links provided by DonationMatch Business Partners and other Services Users, and (vi) Feedback.

Social Users. If you are a Social User, in the course of using the DonationMatch Applications, DonationMatch may receive, directly or through Services Users, Personal Information of yours that may include, but is not limited to, (i) your social media profile (e.g. your Facebook profile name or handle, and its associated email address, but never your password); (ii) information posted on your social media profile such as wall posts, likes, dislikes, or items you follow, but only to the extent that you make this information publicly available or that you provide this information to the Services Users in response to a promotion or other marketing campaign operated by the Services Users by the use of the DonationMatch Applications.

If you are a Services or Social User, we may provide you the opportunity to refer friends or contacts to a Services User promotion. If you choose to do so we may ask you for the referred party's name and/or email address. When you provide this, we will send the referred party a one-time email inviting him or her to view the Services User promotion. DonationMatch stores and uses this information for the sole purpose of sending this one-time email and tracking the success of the referral. The referred party may contact us at support@DonationMatch.com to request that we remove this information from our records.


DonationMatch collects the referred party’s information under the direction of its Services Users and may have no direct relationship with the individuals whose personal data it processes.

INFORMATION DONATIONMATCH COLLECTS

In addition to the information identified above, and regardless of the type of User you are, when you visit the Sites, DonationMatch servers and our third-party tracking-utility partners may automatically record information that your browser sends whenever you visit a website through log files. This information may include, but is not limited to, your computer's Internet Protocol address, browser type, the web page you were visiting before you came to our Sites, and information you search for on our Sites.

Cookies. Like many websites, DonationMatch also uses "cookies" to collect information. We do link the information we store in cookies to any personally identifiable information you submit while on the Sites. A cookie is a small data file that we transfer to your computer's hard disk for record-keeping purposes. DonationMatch uses "persistent cookies" for your convenience to save your registration ID and login password for future logins to the Sites; and we use "session ID cookies" to enable certain features of the Sites, to better understand how you interact with the Sites, and to monitor aggregate usage and web traffic routing on the Sites. Most browsers automatically accept cookies. You can instruct your browser, by changing its options, to stop accepting cookies or to prompt you before accepting a cookie from the websites you visit. If you do not accept cookies, however, you may not be able to use all portions of the Sites or all functionality of our services.

The use of cookies by our service providers and Services Users are not covered by our Privacy Policy. We do not have access or control over these cookies. Our service providers and Services Users use session IDs and other cookies to track the performance of websites and campaigns.

We and/or our third-party service providers employ software technology that helps us better manage content on our Sites by informing us what content is effective. We may tie the information gathered in this manner to our customers' personally identifiable information.

We use or have used, MailChimp, Infusionsoft, Hubspot, Sendgrid, Zendesk, Google Apps, Amplemarket, ActiveCampaign, and other third-party service providers to send HTML-based emails which let us know which emails have been opened by recipients. This allows us to gauge the effectiveness of certain communications and the effectiveness of our marketing campaigns.

HOW DONATIONMATCH USES INFORMATION

We will only share your personal information with third parties in the ways that are described in this Privacy Policy. DonationMatch uses Personal Information obtained by technical means or directly or indirectly from Users for the following purposes: (i) to provide and improve the Sites, the DonationMatch Applications, the services, features and content, (ii) to administer Services Users' membership and Users' use of the Sites, (iii) to enable Users to enjoy and easily navigate the Sites and DonationMatch Applications, (iv) to better understand Users' needs and interests, (v) to fulfill requests Users may submit to DonationMatch, (vi) to personalize Users' experience on the Sites or DonationMatch Applications, (vii) to provide or offer software updates and product announcements, and (viii) to provide Users with further information and enable offers from DonationMatch or third parties that DonationMatch believes Users may find useful or interesting, including newsletters, marketing or promotional materials, discounts, and other information on services and products offered by DonationMatch or third parties.

If you are a Social User, by participating in any campaign or promotion operated by the DonationMatch Applications, you hereby acknowledge and agree that DonationMatch reserves the right to receive, use, store, process, and share your voluntarily provided Personal Information with the relevant Services User who is operating an event, marketing campaign or promotion in which you elect to participate, but solely as necessary for DonationMatch to (a) facilitate Services Users' use of the DonationMatch Applications during such campaign or promotion; and (b) create aggregate reports or other marketing analyses that do not identify Social Users personally for the relevant Services Users operating the campaign or promotion, or for DonationMatch's internal business and marketing analysis. You are hereby informed that it is your responsibility to review and consent to each Services Users' privacy policies and those of the applicable social media platform prior to participating in any marketing campaign or event. Any Personal Information you submit to a Services User or the social media site from which you initiate your participation in an event, marketing campaign, or promotion using the DonationMatch Applications will be governed by the Services User's privacy policy or that of the social media site (and not this Privacy Policy). You understand and agree that DonationMatch does not direct any Services User to collect any Personal Information from Social Users, and therefore DonationMatch assumes no liability in connection with any misuse by a Services User or social media site of your Personal Information, or the failure of the Services User or social media site to obtain your consent to use your Personal Information if such is legally required.

DonationMatch uses tools to track user behavior (including, but not limited to Google Analytics and web server logs). We use this information to improve the customer experience and perform audits for security purposes. OUR LEGAL BASIS FOR PROCESSING YOUR INFORMATION

This section discusses the legal basis for processing your information if you reside outside the United States. You typically provide consent in the United States when you receive notice of this policy in a website link. Some processing is addressed in multiple sections because more than one legal basis may apply depending on the circumstances or service.

We collect and process your personal information for a variety of purposes outlined in this policy. In some instances, separate consent is not required, including: 

  • For the performance of an agreement or contract. To perform our contractual obligations to you, such as fulfilling orders or purchases you have made (including the processing of payment) or contacting you about any issues with your purchase and delivery of our Services. Additional contractual obligations can include when we need to provide your personal information to our service providers when we collect personal information from third parties and you access third-party products and services when we collect data from third parties, or aggregate and centralize data for the performance of our Services.

  • To meet legal obligations. To comply with laws, regulations, court orders, or other legal requirements or to assist in an investigation.

  • For legitimate interests. To operate our business and provide our Services, other than in performing our contractual obligations to you for DonationMatch's "legitimate interests" under applicable law – except where overridden by the interests or fundamental rights and freedoms that require protection of personal data.

  • Through consent. In some cases, we will ask for your consent to process your personal information. You may indicate your consent in several ways, including, as permitted by law, ticking a box (or similar action) to indicate your consent when (i) providing us with your personal information through our Services or a form; or (ii) registering or creating an account with us.  

SERVICE PROVIDERS AND BUSINESS PARTNERS

DonationMatch may employ or partner with third-party companies and individuals to operate the Sites or the DonationMatch Applications to perform DonationMatch Site-related services (such as providing an e-commerce, event ticketing, and fundraising platform, building and maintaining services, database management, customer support, sending emails on our behalf, and web analytics and improvement of the Sites’ features) or to assist us in analyzing how the Sites and the DonationMatch Applications are used. These third parties have access to your Personal Information only to provide the services we’ve requested. These third-party service providers may be located outside of the EEA. 

Referral Codes and Promo Codes: DonationMatch may forward information related to your use of a referral code or promo code to the Services User or Business Partner whose account the code is associated with. For the purposes of auditing the fulfillment of discounts and/or benefits by the associated Services User or Business Partner, information may include your Organization’s name and (if applicable) Event name(s) and date(s), code use/application/transaction date(s), type of transaction to which the code was applied, and purchase amount/discount applied, if any. 

DonationMatch may, with your permission, forward Personal Information you submit to its business partners or other entities with whom DonationMatch has cooperative relationships so that they may send you promotional and other information you have requested from DonationMatch or such Business Partners. If you provide us with your Personal Information for these purposes and would no longer prefer it be used, you may contact us at support@DonationMatch.com

CREDIT CARD PROCESSING

DonationMatch uses an outside, PCI-compliant card processing company to bill Services Users who are purchasing services from DonationMatch. This information is collected and transmitted in a secure manner using SSL encryption. The credit card processing company does not retain, share, store, or use Personal Information for any secondary purposes beyond filling your order. In addition, DonationMatch does not collect credit card data from Social Users who participate in marketing campaigns or promotions.

USER PROFILE INFORMATION

If you are a Services User, DonationMatch displays your submitted User Information, Organization Profile Information, and Listings Information on your profile page and elsewhere on the Sites and DonationMatch partnered and owned sites, which may be publicly visible. Any information submitted on behalf of an Organization, as well as corresponding activity associated with the Organization on the Sites, is considered the property of the Organization. All Services Users undergo a vetting process, during which any of your submitted information may be shared with contacts we find to be publicly associated with the Organization you purport to represent, for the purpose of verifying your role and authorization to represent the Organization. If you engage with another user on the Sites by requesting, accepting, offering, or approving a donation, your submitted User, Organization, and Listing information may be shared with the other party directly for the purposes of reviewing, responding, fulfillment, and/or recordkeeping. You can review and revise your User Information at any time by logging on to your account and making the applicable changes. If you decide at any time that you no longer wish to utilize DonationMatch services, you may contact us at support@DonationMatch.com to request that we remove this information from our database.

If you are either a Website User or a Services User and decide at any time that you no longer wish to receive email or marketing communications from DonationMatch, please follow the unsubscribe instructions provided in any of the communications.

If you are a Social User, you may have the ability to purchase tickets or interact with events by using certain features in the DonationMatch Applications run by Services Users on their managed web pages. If you elect to create a personal profile page on a Services User's event webpage, then you understand and agree that DonationMatch may receive, store, process, and use, any such profile information as necessary to make the relevant features of the DonationMatch Applications available to the applicable Services Users, and as otherwise set forth in this Privacy Policy. For example, you may share, upload, or link photographs, videos, or other content, likes, comments, or other items you have posted from your social media site onto the Services User's event website or social media site. You can review and revise your profile information or change your sharing preferences at any time by logging on to your social media account and making the applicable changes. To the extent that any of this information is Personal Information, you understand and agree that DonationMatch may use that Personal Information for the purposes outlined in this Privacy Policy.

We collect information on behalf of our Services Users. If you are a Social User of one of our Services Users and would no longer like to be contacted by one of our Services Users that use our service, please contact the Services Users that you interact with directly.

If you submit any Personal Information relating to other people to us, our Social Users, our Service Users, or our service providers in connection with the Sites, you represent that you have the authority to do so and to permit us to use the information in accordance with this Privacy Policy.

PUBLICLY-AVAILABLE PERSONALLY-IDENTIFIABLE INFORMATION

Regardless of the type of User you are, you should be aware that Personal Information covered under this Information and Privacy Policy does not and shall not include any information, whether it personally identifies you or not, that you have already made publicly accessible, including through a social media site or directories and listing sites, or have consented to make public through your participation in a marketing campaign or on an event site.

Services Users may create Listings on the DonationMatch Sites for events, goods, gift certificates, products, promotional offers, programs, partnership opportunities, and/or samples for distribution on behalf of their Organizations. Listings whose privacy statuses become “Published,” “Visible” or "Active" at any time are considered publicly available and may be published or promoted by DonationMatch through social media, email, verbally, or other communications. Event listings are by default “Visible,” therefore publicly available to see when published.

DonationMatch hereby notifies you that, while DonationMatch discourages the collection and use of any sensitive personally identifiable information on the part of its Services Users, DonationMatch does not and cannot review or monitor the type of information that Services Users choose to collect from Social Users as a condition to, or in the course of any interaction by use of the DonationMatch Applications.

SOCIAL MEDIA FEATURES

Our Sites include Social Media Features, such as Facebook Like and Share buttons and Pinterest Pin buttons. These Features may collect your IP address, which page you are visiting on our sites, and may set a cookie to enable the Feature to function properly. Social Media Features are either hosted by a third party or hosted directly on our Sites. Your interactions with these Features are governed by the privacy policy of the company providing them.

OUR POLICY TOWARD CHILDREN

Neither the Sites nor the DonationMatch Applications are directed to children under 18. DonationMatch does not knowingly collect Personal Information from children under 13. If a parent or guardian becomes aware that his or her child has provided DonationMatch with Personal Information without their consent, he or she should contact us at support@DonationMatch.com. If DonationMatch becomes aware that a child under 13 has provided DonationMatch with Personal Information, DonationMatch will delete such information from its files, and perform any other acts necessary to comply with applicable laws or regulations.

AGGREGATE OR DE-IDENTIFIED INFORMATION

Aggregated or de-identified information does not personally identify you or any other user of the Sites. DonationMatch reserves the right to use and disclose any information that is aggregate/de-identified in format or does not contain Personal Information (such as statistics and survey results that do not identify you individually by name). 

ACCESS TO, CHANGING OR DELETING YOUR INFORMATION

All Service Users may review, update, correct, or delete the Personal Information provided in their registration or account by making changes on their account and profile pages of the DonationMatch Sites or by contacting us at support@DonationMatch.com. If you request to delete all such information, then your account will become deactivated and you will not be able to use the DonationMatch Applications. The results of activity prior to deactivation--including but not limited to approval of requests, gift certificates received through the use of our service or generated within our system, and/or pending requests for donations--may be canceled.

Any User may communicate with DonationMatch to inquire about DonationMatch's practices set forth in this Privacy Policy. Users who opt-in to receive mail or other communications may opt-out from receiving such marketing communications from DonationMatch at any time by calling DonationMatch, following the specific instructions in the email you receive, or by notifying DonationMatch via the following contact email address: support@DonationMatch.com

Please note that the above will not apply to alerts and communications about the DonationMatch Applications that are considered part of DonationMatch service, in which case you will continue to receive such communications and may not opt out of receiving them unless you cancel your use or subscription to the DonationMatch Applications.

If you are a Social User, your Personal Information may not be stored in a way that enables DonationMatch to individually excise your data. However, your Personal Information will be expunged, overwritten, and/or permanently deleted from DonationMatch's servers in accordance with industry-standard data retention policies and procedures.

DonationMatch does not necessarily have a direct relationship with the individuals whose personal data it processes. A Social User who seeks access, or who seeks to correct, amend, or delete inaccurate data should direct their query to the DonationMatch Services User (the data controller). If the Services User requests DonationMatch to remove the data, we will respond to their request within 30 business days.

We will retain your information as well as information we process on behalf of our Services User for as long as your account is active or as needed to provide records or services to you or other Services Users with whom you interacted through our sites. We will retain and use your information as necessary to comply with federal, state, or local law enforcement; our legal obligations; resolve disputes; and enforce our agreements.

DonationMatch will respond to requests for access within 30 days.

YOUR EUROPEAN PRIVACY RIGHTS

If you are located in the EEA or the UK, you may have the additional rights described below.

  • You may request access to the information we maintain about you, update and correct inaccuracies in your information, restrict or object to the processing of your information, have your information anonymized or deleted, as appropriate, or exercise your right to data portability to easily transfer your information to another company. You also have the right to lodge a complaint with a supervisory authority, including in your country of residence, place of work, or where an incident took place.

  • You may withdraw any consent you previously provided to us regarding the processing of your information at any time and free of charge. We will apply your preferences going forward and this will not affect the lawfulness of the processing before you withdrew your consent.

To exercise these rights please contact us at support@DonationMatch.com. Before fulfilling your request, we may ask you to provide reasonable information to verify your identity. Please note that there are exceptions and limitations to each of these rights and that while any changes you make will be reflected within a reasonable period of time, we may retain information for backups, archiving, prevention of fraud and abuse, analytics, satisfaction of legal obligations, or where we otherwise reasonably believe that we have a legitimate reason to do so. 

TESTIMONIALS

We post customer testimonials with permission on our Sites and our own social media accounts which may contain personally identifiable information or images. We do obtain every customer's consent, verbally or by email, prior to posting a testimonial and posting their name along with their testimonial. If you want your testimonial or name removed, please contact us at support@DonationMatch.com

FEEDBACK

By providing DonationMatch with Feedback, you hereby grant to DonationMatch a royalty-free, worldwide, transferable, sub-licensable, irrevocable, perpetual license to use any Feedback and/or to incorporate such Feedback into the Sites, or DonationMatch Applications or any service or product developed by DonationMatch. You acknowledge and agree that any DonationMatch Application, the Sites, or other product or service incorporating such suggestions, enhancement requests, recommendations or other feedback shall be the sole and exclusive property of DonationMatch and all such recommendations shall be free from any confidentiality restrictions that might otherwise be imposed upon DonationMatch pursuant to your written or electronic agreement with DonationMatch.

LINKS; MARKETING CAMPAIGNS

The Sites and the DonationMatch Applications may contain links to other sites, however, we offer these links merely for your convenience. This Privacy Policy does not apply to the practices of companies that we do not own or control or to people that we do not employ or manage (“third parties”). We have no control over, do not review, and are not responsible for third-party sites, content, or any products or services available through third-party sites. Any data or information you provide to third-party websites, you provide at your own risk. We encourage you to review the privacy policies of any third-party sites that you interact with.

INFORMATION SECURITY

DonationMatch takes industry-standard precautions to protect Personal Information. For example, whenever DonationMatch collects credit card data or other payment information, that information is protected using industry-standard encryption and transmitted to DonationMatch in a secure way. You can verify this by looking for "HTTPS" at the beginning of the address of the particular web page.

While the safeguards implemented by DonationMatch may help prevent or slow unauthorized access, maintain data accuracy, and facilitate the appropriate use of data, NO GUARANTY IS OR CAN BE MADE THAT YOUR INFORMATION IS SECURE FROM INTRUSIONS AND OR UNAUTHORIZED ACCESS BY THIRD PARTIES. COMPLIANCE WITH LAWS AND LAW ENFORCEMENT

DonationMatch cooperates with government and law enforcement officials and private parties to enforce and comply with the law. DonationMatch will disclose any information about you to government or law enforcement officials or private parties as DonationMatch, in its sole discretion, believes necessary or appropriate to respond to claims and legal processes (including but not limited to subpoenas), to protect the property and rights of DonationMatch or a third party, to protect the safety of the public or any person, or to prevent or stop any activity DonationMatch may consider to be or to pose a risk of being illegal, unauthorized, unethical, inappropriate or legally actionable.

BUSINESS TRANSFERS

DonationMatch may sell, transfer or otherwise share some or all of its assets, including your Personal Information, in connection with a merger, acquisition, reorganization, or sale of assets or in the event of bankruptcy. You will be notified via email and/or a prominent notice on our Sites of any change in ownership or uses of your personal information, as well as any choices you may have regarding your personal information.

LOCATION OF DONATIONMATCH SERVERS AND CROSS-BORDER TRANSFER

DonationMatch Sites are operated from the United States and are not intended to subject us to the laws or jurisdiction of any state, country, or territory other than that of the United States. DonationMatch computer systems are currently based in the United States, so your Personal Information will be processed by us in the United States. In accordance with applicable law, Personal Information collected on the Sites may be transferred, stored, and processed in the United States, which may have different data protection rules than those of your country. By submitting your Personal Information to DonationMatch or the DonationMatch Applications, directly or indirectly through a Services User, you consent to such processing of your personal information.

YOUR SENSITIVE PERSONAL DATA

We ask that you not send us or disclose any sensitive personal data (e.g., social security numbers, information related to racial or ethnic origin, political opinions, religion or other beliefs, health, biometrics or genetic characteristics, criminal background or trade union membership) on or through the Sites, Services, or otherwise to us. For example, do not send us or insert sensitive personal data into your DonationMatch site profiles or pages, contact forms, direct messages to other users, email communications, chat, Customer Support calls, or messages, to name a few.

CHANGES TO THIS POLICY

DonationMatch may revise this Information and Privacy Policy from time to time. The most current version of the policy will govern DonationMatch’s use of Personal Information and will always be at http://www.DonationMatch.com/privacy. If DonationMatch makes a change to this policy, DonationMatch may notify you via an e-mail to the email associated with your account or the change will be effective by posting the change to the Sites. If we make any material changes, we will notify you by email (sent to the e-mail address specified in your account) or by means of a notice on this DonationMatch Site prior to the change becoming effective. We encourage you to periodically review this page for the latest information on our privacy practices. By continuing to access or use the Sites or the DonationMatch Applications after those changes become effective, you agree to be bound by the revised Privacy Policy.
